Mailfly

Terms of service

Last updated 18 October 2026 · Also: Privacy policy · GDPR and data protection

1. Who we are

Mailfly is run by DF Media Limited, a company registered in England and Wales with company number 14556277, at 20-22 Wenlock Road, London, N1 7GU, United Kingdom ("we", "us"). Contact us at hello@mailfly.ai, through the contact page, or by post at that address.

2. The agreement

These terms are an agreement between DF Media Limited and the business that opens a Mailfly account ("you"). They include our privacy policy and the data processing terms on our GDPR page. By making an account, you accept them, and you confirm that you may accept them for the business. You must be at least 18 and use Mailfly for a business, not as a consumer.

3. The service

Mailfly lets you keep a list of contacts, collect sign-ups, write emails, send them by hand or by automation, and see what happened. Each plan has the features and limits on the pricing page. We may change features to improve the service. We tell you before we remove a feature that you pay for.

4. Your account

  • Give us true details, and keep them up to date, including your company details: they go in the footer of your emails.
  • Keep access to your email address safe: anybody who can read it can sign in.
  • Keep API keys secret. Delete a key you no longer use.
  • API keys and connected AI apps have limits: requests an hour for each key, and the number of keys a business can have. Settings → API and AI apps shows yours. We may change the limits of an account to protect the service.
  • You are responsible for what is done in your account, also by your team and by the tools you connect.

5. Your list and the law

  • Email only people who agreed to hear from you, or whom the law lets you email (for example existing customers under the UK "soft opt-in", or company addresses).
  • Record the lawful basis for each contact. Mailfly does not send a campaign to a contact with no lawful basis.
  • Use the consent tools on your sign-up forms where the law needs consent, and give people your own privacy notice.
  • Do not use bought, rented, shared or scraped lists, or addresses you collected for another purpose.
  • Do not import, or send to, people who unsubscribed or complained in another service.
  • Follow the law that applies to you and to the people you email, for example UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations (PECR), EU GDPR and the US CAN-SPAM Act.

6. What you must not send

  • Spam, or email to people who did not ask for it where the law needs consent.
  • Anything illegal, misleading or deceptive, including false sender details or subject lines.
  • Phishing, malware, or links to them.
  • Content that harms, harasses, threatens or discriminates against people.
  • Content that you have no right to use, or that breaks another person's rights.
  • Sexually explicit content, or content about illegal drugs, weapons or gambling where it is not lawful.
  • Special category data (for example health data) in your contacts or tags.

7. Sending rules

  • Every email carries your business name, company details, why the person gets it, and a working unsubscribe link. Mailfly adds them for you; do not hide or remove them.
  • A new sending domain warms up: it sends a limited number of emails a day for the first weeks. Our team sets that number for each domain, and can change it when you ask.
  • On the Free plan, your first send to more than 100 people waits until our team checks it for spam. We may refuse it, with the reason. After one approved send, no more checks. Sends to 100 people or fewer go at once.
  • We pause a campaign, and switch off an automation, when bounces or complaints pass safe limits (4% bounces or 0.1% complaints).
  • Emails from our shared sending domain carry your business name; replies go to you.
  • Our team can look at the emails you send or schedule (the words, pictures and links) to check them against these terms and to stop spam, phishing and abuse. We see them filled in for a made-up person.

8. Plans and payment

  • Each plan has the limits and features shown on the pricing page.
  • Paid plans are billed monthly or yearly in advance, in pounds or US dollars (you choose before your first payment), with no VAT added, through Stripe.
  • Extra emails over a paid plan's monthly emails are billed after the billing period (on a yearly plan, after the year) at the price on the pricing page, and never more than the limit you set in Billing. Set 0 and no extra emails are sent.
  • You can cancel at any time. Your plan then runs to the end of the month or year you paid for. We do not refund part periods, except where the law requires it.
  • If a payment fails, Stripe tries again. If it still fails, your account moves to the Free plan's limits; nothing is deleted.
  • We tell you at least 30 days before a price change takes effect.

9. Your data

Your contacts and your emails stay yours. For your contacts' personal data, you are the controller and we are your processor, under the data processing terms on our GDPR page. We use the data only to run the service for you. We do not sell it, use it for our own marketing, or use it to train any AI model.

10. Your content

You keep the rights in what you put in Mailfly: your emails, pictures, templates, forms and pages. You give us the right to store, copy and send it only to run the service for you. You promise that you have the right to use it.

11. Our property

Mailfly, its software, design and templates belong to DF Media Limited. You may use our templates in your own emails. You must not copy, resell or try to get around the limits or security of the service, or use it to build a competing service.

12. Suspension

We may pause sending, or suspend an account, if it sends spam, gets too many bounces or complaints, breaks these terms or the law, or puts the service or other customers at risk. If we can, we tell you first and explain why. We restore it when the problem is fixed.

13. Availability

We work to keep Mailfly available and your data safe, but we cannot promise that the service will always work without breaks or errors. Email services decide what reaches the inbox; we cannot promise delivery or opens.

14. Liability

  • We are not liable for loss of profit, revenue, business, data or goodwill, or for indirect loss.
  • Our total liability in any 12 months is limited to the amount you paid us in those 12 months.
  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not let us limit.

15. Your promise to us

If somebody makes a claim against us because of your list, your content, or how you used Mailfly against these terms or the law, you will cover our reasonable losses and costs.

16. Ending the agreement

You can close your account at any time: an owner presses Close this business in Settings. An owner can reopen it within 7 days. We can end the agreement with 30 days' notice, or at once if you seriously break these terms. Before you close it, download your contacts as a file on Subscribers. We delete your data 7 days after the account closes, and always within 30 days.

17. Changes to these terms

We tell you by email at least 30 days before an important change takes effect. If you continue to use Mailfly after that date, the new terms apply. If you do not agree, you can close your account before that date.

18. General

  • Neither of us is liable for a delay caused by events outside its reasonable control.
  • You may not transfer this agreement without our consent. We may transfer it to a company that takes over Mailfly, and we tell you.
  • If a court finds part of these terms invalid, the rest stays in force.
  • These terms, with the privacy policy and the data processing terms, are the whole agreement between us about Mailfly.
  • We send notices by email to the owners and admins of your account. A notice about the service can also show as a banner in the app.

19. Law

The law of England and Wales applies to these terms, and the courts of England and Wales decide any dispute.
